Buyer shall give consideration in the form of the purchase price of $_______________.00, and

performance in accordance with the terms and conditions set forth in this agreement.

Seller shall give consideration in the form of delivering the purchased animal, and performance

in accordance with the terms and conditions set forth in this agreement.

The Seller hereby accepts a non-refundable deposit of $400.00 (to be given/mailed to Seller with

contract) toward the purchase of the puppy identified below.

The full purchase price is $_______________.00 and the balance of $_______________.00 is

due in full on ___________ 20__ when the puppy is eight weeks old. Crate, Shipping, and any

additional Handling expenses are the responsibility of, and shall be paid for by, the Buyer. The

current flat rate for this service is Four Hundred Dollars ($400.00). Buyer agrees to this

additional charge for this additional service.

SELLER REPRESENTATIONS AND LIMITED WARRANTY

Seller Represenations. The Seller represents that:

(a) the above puppy has been examined by a licensed Veterinarian and was found to be

in good health;

(d) the application for registration of this puppy is limited* as defined by the American

Kennel Club (“AKC”) and this puppy is not being sold for the purposes of breeding

(e) the application for registration of this puppy is full* as defined by the American Kennel Club (AKC) and this puppy is being sold for the purposes of breeding and/or showing.

*Limited Registration means that the dog is registered with the AKC but no litters

produced by the dog are eligible for registration. Dogs with limited registration may

not be entered in breed competition(s) at Dog Shows but may compete in all other

AKC events. The litter Owner may later apply to change this designation and have

the dog given full registration privileges, but a fee and special application are required

for this change.

*Full Registration means that you have breeding and/or showing rights to this puppy. However, to obtain this you agree to be a responsible breeder by limiting the registrations of any puppies produced by this dog and by taking all of the necessary steps to having a healthy dog and litter. You must also be selective in choosing a mate for this puppy, and only choose a dog of quality. Either one that is already a champion or one that comes from champions. Lastly, we do not require this, but we really appreciate if you name your dog after our kennel (example: Gold Standard Logan or Logan of Gold Standard) on his/her registration papers.

(d) reasonable precautions have been taken to prevent this puppy from acquiring

hereditary defects of the hips, eyes and heart.  A two-year guarantee against any life-threatening

hereditary defects will be given with the puppy at the time of sale.

Seller’s Limited Warranty. Seller hereby warrants only the following:

Should the animal purchased under this agreement be diagnosed by a board certified specialist as

being affected by hereditary defects of the hips, elbows, eyes and/or heart, the Sellers will at the Seller’s sole discretion take the puppy back and replace it with a puppy from another breeding,

as long as said diagnoses and request for replacement happen within two (2) years of the

animal’s birth date for any purchased animal suffering a hereditary defect(s)

The seller makes no warranty as to the eventual personality of the animal due to the

influence of environment and training techniques, or the lack thereof.

No other warranty pertaining to merchantability of the animal purchased, fitness for a particular

purpose, or any other type of warranty, whether explicit or implied, is given by the Seller. The

only warranty given is specifically stated above and limited to those terms.

agreement. This limited warranty is the only warranty given on the animal purchased under thisagreement.

Gold Standard Kennel’s Full Registration Contract

(This contract is separate from the original buy/sell contract. Both must be completed)

_______ I understand that this dog is being sold on full registration, which means that Gold Standard Kennel is allowing me breeding/showing rights. Gold Standard Kennel has chosen a puppy that they think would be the best fit for a breeding/showing program. Breed-ability is NOT guaranteed

______I understand that this puppy is being sold with a 2 year guarantee on hips, elbows, eyes, and heart. I must take my puppy between the ages of 18 months and 2 years to get his/her hips, elbows, eyes, and heart tested (OFA and CERF must be 2 years of age). I agree NOT to breed any puppy that does not pass (average or higher is passing)  In the event that a puppy does not pass, Gold Standard Kennel will replace that puppy with a puppy of equal or lesser value of the same sex when available.

_______I understand that if I breed this dog before I have his/her hips, elbows, eyes, and heart certified, this and all guarantees/contracts given by Gold Standard Kennel will be VOID.

______I hereby agree that I will not breed this dog more than 2 times in a row. I will either breed 1 time per year or 2 times and give a break.

______If this dog is a female, I hereby agree not to breed her more than 5 times or after she is 5 years old, whichever comes first.

______I hereby agree to seek the opinion of my vet on the health of this dog before each breeding.

________I hereby agree to provide this dog with proper shelter from all weather conditions. I also agree to provide this dog with plenty of fresh air, exercise, fresh water, a daily multivitamin, and a premium dry dog food.

_______I hereby agree to send copies of all litter records from this dog to Gold Standard Kennel at 146 Moore Lane, Shamokin, PA 17872.

_______I hereby agree to sell every puppy from this dog on limited registration unless special, WRITTEN permission is given by Gold Standard Kennel upon birth of a puppy of exceptional breeding/showing quality.

STUD SERVICE CONTRACT

This is to certify that the stud dog:__________________________________________, AKC#:________________________________________,

was bred to the bitch:______________________________________________________, AKC#:________________________________________,

on the following dates:_________________________________, and is due to whelp on or near the dates:_________________________.

Conditions of Service

1. The stud fee for this mating is $_______________.

[ ] The fee is payable at or before the time of mating by certified check or cash.

[ ] The fee will be fulfilled by the selection of a puppy from the resulting litter as agreed to by both parties. Terms of selection are as follows:

2. All fees are payment for the stud service only and are not to be construed as a guarantee of puppies. If the bitch fails to whelp or whelps fewer than two living puppies at birth, the owner of the bitch must notify the stud dog owner not more than 65 days after the date of the last mating. There shall be no refund in whole or part, but a return service to the same stud shall be provided at the same bitch's next heat if both are still available; if not available, to an agreed alternate.

3. If a bitch fails to whelp or give birth to two living puppies as a result of this second mating, then this agreement shall be terminated and the stud dog owner shall have no further obligations.

4. If ownership of the bitch changes, right of return service shall be at the option of the stud dog owner.

5. Owner of the bitch agrees to keep the bitch confined and inaccessible to all other male dogs from the start of her heat cycle until the bitch is fully out of heat.

6. Owner of the stud dog agrees to keep the bitch to be bred confined and inaccessible to all other male dogs until the bitch has been bred and returned to her owner.

7. Reasonable care will be given to the bitch while in the possession of the stud dog owner. Any veterinary fees incurred during this time are the responsibility of the bitch owner.

9. The bitch owner agrees that all puppies resulting from this litter will be properly cared for and placed in the proper homes.

10. No puppy resulting from this breeding shall be transferred to wholesale outlets, dog dealers, brokers, humane shelters, laboratories, pet shops or their agents.

11. Bitch owner agrees to have buyers sign a contract including the statement that they will not transfer said puppies or their offspring to wholesale outlets, dog dealers, brokers, humane shelters, laboratories, pet shops or their agents.

12. Bitch owner agrees to sell all pets as non-breedable and will enforce this term by checking the limited registration box on the AKC registration form.

13. Bitch owner agrees to require that all pups sold for show/breeding must be checked and have the necessary health clearances before being bred (for example, eye, hip, vWD, brucellosis, etc.).

14. Bitch owner agrees to furnish the stud dog owner with the name, address and telephone number of the owners of the puppies from this litter and the purpose for which each puppy was sold.

15. The owner of the stud will appraise the offspring of this breeding for the owner of the bitch at no charge when the puppies are six weeks of age. The owner of the bitch shall make an advance appointment for this service.

17. Bitch owner agrees to pay a penalty of $500 for each and every violation of this contract.

18. It is specifically agreed that the stud dog owner is not obligated to sign the application for registration of this litter until the stud fee has been paid in full or, in the case of a puppy fee, the stud owner has possession of the puppy or puppies as agreed. Nor is the stud dog owner required to sign the litter application if any of the conditions in this contract have not been followed or if there is a question as to the parentage of the resulting puppies.

We have read and understand the conditions of this contract. Any/all fees incurred in the enforcement of this contract shall be borne by the party in default. By our signatures we agree to these conditions and acknowledge having received a copy of this contract.
